Terms of Service
Who you are agreeing with
Beacon is made and sold by Brad Wyse, a sole proprietor in Canada. By installing or using Beacon you agree to these terms. If you do not agree, do not use it.
Your licence
We grant you a personal, non-exclusive, non-transferable licence to use Beacon on the devices you use, for as long as your subscription or trial is current. The licence is for one person. You may not resell, sublicense or redistribute Beacon, or attempt to defeat its licensing.
Trial, subscription, and what expiry means
Beacon offers a 30-day trial with no card required. After that, a current subscription is needed to keep using the app.
When a licence expires, Beacon locks. There is no perpetual fallback version — a subscription that has ended is a reason for us to stop providing the software. It is never a reason to hold your data. Export, print, search and cloud sync keep working in every state, including after expiry, so you can always take your notes, tasks and settings with you. Your mail and calendar are, and always were, in your Google account.
Your data is yours
Beacon stores its data on your computer and, if you choose, in your own Google Drive. We hold no copy and can neither read nor recover it. Backing up your own machine remains your responsibility; Beacon keeps rolling local copies of its database to protect against its own failures, not against the loss of the device.
Google accounts
Beacon connects to Google services on your behalf, and your use of those services remains subject to Google’s own terms. You are responsible for having the right to access any mailbox you connect. We are not affiliated with or endorsed by Google.
Acceptable use
Do not use Beacon to break the law, to send unsolicited bulk email, or to access an account you are not entitled to access. We may end your licence if you do, without refund.
Availability and changes
Beacon is desktop software: there is no service to go down, and it keeps working offline. Features may be added, changed or removed between versions, and updates install automatically unless you turn that off. Where a change removes something you relied on, we will say so in the release notes.
Refunds
Purchases are handled by our payment provider, who is the merchant of record. If Beacon is not what you expected, write to hello@mybeaconapp.io within 30 days of purchase and we will refund you. The 30-day trial exists so you can find that out before paying anything.
No warranty
Beacon is provided “as is”, without warranty of any kind, express or implied, including fitness for a particular purpose. We do not warrant that it will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here limits rights you have under mandatory consumer law.
Limitation of liability
To the fullest extent the law allows, our total liability arising out of your use of Beacon is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, or for lost data or lost profits. Again, nothing here limits liability that cannot lawfully be limited.
Ending the agreement
You may stop using Beacon at any time, and cancel through the payment provider. We may end this agreement if you materially breach these terms. On ending, your licence stops but your data stays where it always was — on your machine, and in your own Drive.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction — without affecting any right you have to bring a claim where you live.
